IFON Member Receives Compensation after Trip in Hospital Car Park

Our member was involved in an accident that wasn’t his fault in February 2017. He was walking across the car park at Stobhill Hospital when he tripped and fell as a result of an uncovered manhole cover. As a result of tripping and falling he sustained injuries to his back, knees and hands. He asked IFON for assistance and we referred him to NewLaw Scotland, a specialist personal injury firm for free legal assistance.

Following investigations it was discovered that contractors working on site around the time of the accident had left the manhole uncovered. A claim was intimated to the contractors on the member’s behalf and their insurers confirmed they were prepared to accept liability for the accident. Our specialist solicitors instructed a medical expert to examine the member in order to determine what injuries he sustained as a result of the accident.

Once the medical report was received NewLaw Scotland sent it to the insurers acting for the contractors with their valuation of the claim. An initial offer of £1,515 was put forward and after a period of negotiation settlement was agreed for our member in the sum of £3,000.

As the member had contacted IFON and taken advantage of the legal services offered as part of the membership he was entitled to keep 100% of his compensation and didn’t have to pay anything for the legal advice he received.

Member Seeks Assistance from IFON following Road Traffic Accident

One of our members was recently involved in a car accident. As he was sitting stationary at the entrance to a roundabout his car was struck from the rear by another vehicle. The member, employed as a nurse in Glasgow, sustained an injury to his back and neck as a result of the accident. He also had to spend money to replace the child’s seat in his car. His insurers dealt with the repairs to his vehicle but he contacted IFON for assistance in relation to his personal injury claim.

The member was referred to NewLaw Scotland, a personal injury law firm with a dedicated RTA department. The solicitor assigned to his case intimated a claim on his behalf and liability was quickly accepted. Medical evidence was obtained in support of his injuries and NewLaw Scotland negotiated an award of £3,500 to compensate him for his injuries and the replacement car seat.

By taking advantage of IFON Legal Xtra the member received specialist assistance from a personal injury solicitor and was entitled to keep 100% of the compensation awarded to him. If he had gone to the solicitors nominated by his own insurance company he would have had to pay 20% of his compensation to them for legal fees.

IFON Legal Xtra Service Extended to Member’s Mum

One of our member’s based in Glasgow contacted IFON to find out if the Federation could assist his mum after she slipped and fell in a local supermarket. IFON Legal Xtra services have now been extended to your family members so our member’s elderly mother was also entitled to free legal assistance from a specialist personal injury law firm.

She was referred to NewLaw Scotland, an expert personal injury firm, who immediately began to investigate the accident circumstances.  The member’s mother slipped on a puddle of water in one of the aisles.  The solicitor dealing with the case was able to obtain evidence to show one of the freezers had been leaking for some time and at the time of the accident there were no wet floor signs in place. After initially denying liability for the accident the insurers acting for the supermarket confirmed they would settle the claim.

Our member’s mum fractured her hip when she fell and sustained some other bruising. Compensation was agreed in the sum of £10,000 and because she had used her son’s IFON legal benefits she kept all of the compensation awarded to her and didn’t have to pay anything for the expert legal advice.

Member Bitten at Work Receives £8,500 Compensation

Our member, employed as a nurse, was bitten in the course of his employment by a patient. As a result of his injuries he was absent from work for over a month and was left with permanent scarring on his arm. He sought assistance from IFON and his case was passed to NewLaw Scotland, a specialist personal injury law firm. As part of his membership he was entitled to free legal assistance to pursue a claim for injuries sustained as a result of any accident or assault.

We worked alongside NewLaw Scotland to obtain evidence of the inferior risk assessments carried out in relation to the patient.  We also obtained evidence to show bite guards had been requested by members of staff but never supplied by the Health Board. As a result of disclosing this evidence to the solicitors acting for the Health Board liability was admitted.

When the Health Board confirmed they were prepared to settle our member’s claim NewLaw Scotland instructed an independent medical expert to prepare a report in relation to the injuries sustained and they obtained a copy of the member’s payslips to calculate the earnings he had lost as a result of his absence.

When all of the evidence was disclosed settlement was agreed in the sum of £8,500. Our member kept 100% of his compensation.
